The commutation follows Parliament’s enactment of a new law to limit the death penalty for murder to killers of policemen and prison guards for a five-year trial period. A justice department spokesman said that Tuesday notices of the decision were sent Monday to the prisoner. The prisoner, Robert Kellin, 43, of Trail, was sentenced to 10 years in 1963 for the murder of a police officer. He was released in 1967 after serving 7 years. The new law, which came into effect on January 1, 1968, provides that the death penalty shall not be imposed for murder unless the victim is a police officer or prison guard. The commutation was made by the Supreme Court of Canada, which ruled that the new law applied retroactively to cases pending at the time. The prisoner, who has been in prison since 1963, was released on parole in 1967 after serving 7 years of his 10-year sentence. The new law is intended to reduce the number of executions and to provide a more humane system of punishment for murder.
